This guy definately could have handled it different and if you'll notice there's a clip of video missing around the 7 min. mark.

In SD, refusal to sign the promise to appear is an immediate arrest. That said, there were several potential opportunities to solve this without an arrest or force. I say "POTENTIAL" because we didn't get to see how this guy would have responded to a more diplomatic approach. It's easy to Monday morning quarterback, but even hindsight isn't really 20/20 sometimes.

I work with some guys like this and I am pretty sure that this guy could have handled this about 3 different ways that would not have involved force or arrest. I am not certain of the laws there, but the jurisdiction I am in, not signing the summons or the ticket will not get you arrested, and it won't get you out of the citation either. This guy reacted badly and I can just tell from the video that an attorney very likely got his 33 percent from the large settlement check written by this department.

I have had many people tell me they are not gonna sign my ticket. I then calmly explain that their signature is not an admission of guilt or means that they agree with it. Their signature is just saying that they have received a copy of the ticket and they will take care of it by either waiving it through the mail or by going to court to fight it. Sometimes they still don't want to sign it. In which case I explain that if they do not sign the ticket then I will write refused on the ticket and they will be placed under arrest. Maybe if this officer explained it like that the situation would of ended differently..... then again maybe not.....but I def agree with tazing him when he was told he was under arrest and he walked back to the vehicle.
